These general terms and conditions of sale describe the terms and conditions of sale on the website www.jle.com.
They apply exclusively between JLE, a company with a share capital of €3 307 286, registered in the Créteil Trade and Companies Register under number 982 935 8768, with its registered office at 30 rue Berthollet, 94110 Arcueil, France, and all natural or legal persons making a purchase (book, subscription magazine, journal number, article, etc., in "paper" or electronic format) via the website www.jle.com.
The fact of placing an order implies the Customer's acceptance of these general terms and conditions of sale. These general terms and conditions of sale may be subject to change, the conditions applicable to the sale are those accepted by the Customer on the site at the time of placing the order.
The statements and/or opinions contained in the articles or other documents published/posted on this site are those of the individual authors and contributors. JLE shall in no event be liable for any damage or injury to persons or property, whether resulting from product liability, negligence or otherwise, or from the use of the products, methods, instructions or ideas contained in the information accessible via this site.
In particular, JLE shall not be liable for the accuracy of any information contained in articles or other documents published/displayed on this site and disclaims any liability for any error and/or omission and/or for any damage and/or injury to persons or property arising in the performance of any method, instruction or idea contained in such documents.

Preliminary warning
JLE publishes 36 journals, including medical journals reserved exclusively for healthcare professionals or affiliates. These journals are available by subscription. Their electronic version is only available to authenticated users who have certified their status.

Why do we collect your data?
Your data are collected as part of your registration on the www.jle.com website and as part of the purchase of a book, issue or article from our journals. These data are processed electronically under the responsibility of JLE, whose registered office is located at 30 rue Berthollet, 94110 Arcueil, France.
Data processing is used for management purposes, customer relationship management, and the sending of offers that can be personalised. Your data will be used for these purposes only and in the strictest confidentiality. Their use is based on your consent, which you can withdraw at any time.
Who is your data for?
Your data, stored in a secure computer file, is intended exclusively for JLE and for service providers authorised to process your data solely on behalf of JLE.
We do not share your personal data with third parties. We do not sell or rent your personal data.
How to access, correct or delete your personal data?
In accordance with Law No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties and the General Data Protection Regulation (GDPR) No. 2016/679 of 27 April 2016, you have the right to access, rectify, delete, recover your data, as well as the right to oppose any direct marketing campaign or profiling operation, under the conditions provided for by the GDPR.
You can exercise your rights with JLE by e-mail or by post. Any request to exercise your rights must be accompanied by proof of identity and sent to webmaster@jle.com or by post.
At any time, you can manage your subscriptions to the services offered in the "My Account" section of our website www.jle.com.
Retention of your data
We keep your data as long as we provide you with our services and products.
We will delete your data after two years, if your login details have not been used and if no subscriptions or orders for books, issues and journal articles are in progress.

JLE uses cookies to analyze site visit statistics and allow you to keep your session data, your identification on our site.
Formation of the Contract
The purchase of any of the products or services offered on the site is made via a duly completed order form by which you select your products or services and complete the delivery and payment details. We recommend that you print this page for future reference.
The acceptance of your order will be materialized by a confirmation e-mail with an order reference number ("Confirmation E-mail"). Once your order has been accepted, you will no longer be able to modify or cancel it (subject to any right of withdrawal).
Prices
The prices of the products and services offered on the site will be those mentioned on the site on the date you place your order. Prices are subject to change at any time by the publisher, without notice, knowing that the items will be invoiced on the basis in effect at the time the order is placed.
Concerning books: all prices are indicated excluding postage, packaging and delivery costs and Value Added Tax included. Any other sales tax is indicated separately on the Site and/or on the confirmation e-mail.

Invoicing
Book purchases made on the www.jle.com website are subject to an invoice available for download in your customer area.
For subscriptions to our journals, as well as purchases of articles à la carte (Pay per View), an invoice will be sent to you upon request to our customer service by email: abonnements@jle.com
Delivery - Shipping costs
Unless otherwise specified, delivery is made by La Poste to the address indicated at the time of ordering.
The ordered items remain the property of JLE until they have been paid in full and handed over to the carrier.
Deliveries abroad are under the responsibility of the customer. It is his responsibility to obtain the necessary information from the local authorities concerned and to ensure compliance with the specific formalities relating to the importation of these items into the territory of destination. Any customs fees or local taxes are the responsibility of the customer (see article Prices).
Our prices are calculated ex warehouse. We take care of part of the costs of preparing, packing and shipping your package. We simply ask you for a flat-rate contribution to the delivery costs related to the delivery method and destination.

The deadlines given to you are for information only and may vary according to destinations and events related to transport service providers.
If the items delivered to you do not include all the items you have ordered in any particular order or include incorrect items, you must notify us in writing as soon as possible. In any event, our liability is limited to the price of the undelivered items or the cost of replacing them.
Specific conditions of sale related to subscriptions
Offer
Individual, Student and Member Subscription
For subscriptions including the paper version, the customer receives the paper copies at the address he indicated when ordering, as soon as each issue is published.
Shipping costs are included in the indicated prices.
For subscriptions including the web version, the customer can access the electronic version throughout the duration of his subscription on the website www.jle.com. Subscription includes the consultation of current issues, archives and any other online content included in the subscription of the journals concerned. This subscription also includes subscription to the journal's electronic communications.
Access codes (username and password) are sent, on a strictly personal basis, by e-mail to the address indicated when ordering. If no e-mail has been entered, it is possible to activate your account directly on the site using the subscriber number (see invoice or customer service).
As the Individual, Student or Member subscription is reserved for individual use, it is strictly forbidden to sell it or share your access codes with other users. In the event of a breach, JLE reserves the right to prosecute the offenders.
The subscription ends with the publication of the last issue of the period for which the subscription was subscribed.
Institutional Subscription
The Institutional subscription concerns any subscription subscribed by an administration, a hospital, a library, an association, a commercial company, a health industry or a public administrative establishment.
▪ Subscriptions including the paper version
The customer receives the paper copies at the address indicated when ordering, as soon as the issue is published. Shipping costs are included in the indicated prices.
▪ Subscriptions including the web version
At the time of his first order, the customer must attach a duly completed and signed license agreement.
The customer accesses the electronic version throughout the duration of his subscription via the website www.jle.com or via the direct URLs linked to the journals. Subscription includes the consultation of current issues, archives and any other online content included in the subscription of the journals concerned.
▪ For establishments with less than 20 users or less than 1000 FTEs (Full Time Employees) located on a single geographical site, access is left free, at your choice: login - password or automatic IP address recognition (indicated in the license agreement and/or in the order form). Institutions in this category benefit from the rates indicated on the website.
▪ For establishments with more than 20 users or more than 1000 FTEs (Full Time Employees or full-time employees) or for any establishment located on several sites, access to the content will be achieved by automatic recognition of IP addresses (indicated in the license agreement and/or in the order form). These institutions should contact the specialized agencies or our sales department institutions@jle.com to obtain a personalized quote.
Supplements / additional volumes
Additional volumes are sometimes published. Some of these special supplements are not included in the subscription price and are only provided upon receipt of a separate order.
Start and end of subscription
Subscription begins as soon as the payment is registered. It runs for the duration chosen when ordering.
When the subscription expires, it is not tacitly renewed.
Subscription rates
Individual rates
For individual rates, the subscription and payment must be in the name of an individual.
Payment cannot be made by an administration, a health industry, a research laboratory, a private company, an association or a library.
All payments are made in full with the order, the subscription will not be served otherwise.
The shipping costs for paper copies are included in the indicated prices.
Student rates
The student rate is only granted on presentation of proof (double-sided copy of the valid student card or valid certificate). You can send us these documents by mail or by uploading them directly to your personal account on our website.
This subscription is in no case subject to the issuance of an invoice.
All payments are made in full when ordering, the subscription will not be served otherwise.
The shipping costs for paper copies are included in the indicated prices.
Institutionnal rates
This rate applies to any subscription subscribed and paid by a legal entity: administration (hospital service, research laboratory, university, etc.), library, association, commercial company, health industry, health care institutions, medical practice, etc.
Payment can be made by credit card, cheque, bank transfer or administrative money order.
An invoice is automatically issued.
The customer can communicate his intra-community VAT number when ordering to be exempt from taxes.

General conditions related to the purchase of Pay per View articles
Offer
« Pay Per View »: Our customers are allowed to acquire an article, which can be viewed online, in the JLE journals, available on the website www.jle.com.
Access to content
A personal account is required at www.jle.com.
Your payment validates your right of access to the chosen item and marks your waiver of any right of withdrawal.
Once it has been validated, log into your account at www.jle.com, return to the chosen article and click on the "full text" tab.
The content read online by the customer is digital files protected by national and international copyright laws, their use may only be made in a private context.
However, some articles are not available in PDF format.
The rights granted to you over the content of the chosen article are granted on a personal basis, for your own use.
These rights of use are non-transferable, non-transferable and non-transferable.
Any making available to third parties by any means, any distribution or redistribution to third parties in any form, is strictly prohibited. In particular, any free or paid replay or resale of the content in any form whatsoever is prohibited.
General conditions related to journal purchases by issue

"Purchase by issue" refers to the offer allowing customers to acquire a paper issue from one of the journals in the JLE catalogue, available on the website www.jle.com.

Our issues are offered within the limits of available stocks.
Our database is regularly updated. Nevertheless, some items may have escaped our vigilance and may be temporarily or permanently unavailable.
If the product you order is not immediately available upon receipt of your order, we undertake to inform you immediately of the additional delivery time.
If we are unable to provide you with the item ordered due to a definitive break, we will immediately inform you, cancel your order and proceed with the refund.
General conditions for the sale of paper books
Availability of items

The pre-order gives you the possibility to reserve the item and to dispose of it as soon as it is officially published. However, we reserve the right to change the delivery date. In this case, we undertake to keep you informed. You can cancel the order of the item in pre-order on simple request to our customer service. At your request, a refund can be made.

Prices
The books are sold in accordance with the Lang Law of 10 August 1981, on the single price of the book.
For orders destined outside metropolitan France, customs duties or other local taxes (value added tax, customs tax, import duty) may be payable. These taxes are the responsibility of the customer and are his responsibility.
Warranty
The www.jle.com website is subject, for consumers, to the conditions of legal guarantees provided for in Articles L. 211-4, L. 211-5 and L. 211-12 of the Consumer Code and Articles 1641 and 1648 of the Civil Code referred to in the box below and reproduced below. To enforce the legal guarantees, we invite you to contact the site's customer service department.
It is recalled that under the legal guarantee of conformity, our customer:
- has a period of two years from the delivery to take action against its seller ;
- may choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code ;
- is exempted from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods. This period is extended to 24 months from 18 March 2016, except for second-hand goods.
The legal guarantee of conformity applies independently of any commercial guarantee granted.
It is recalled that the consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he may choose between cancelling the sale or reducing the sale price in accordance with Article 1644 of the Civil Code.

The seller is required to deliver a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He shall also be liable for any non-conformity resulting from packaging, assembly instructions or installation where the costs have been borne by him under the contract or where they have been carried out under his responsibility.
▪ Article L211-5 - Consumer Code
To be in conformity with the contract, the good must:
- Be specific to the use usually expected of a similar asset and, if applicable:
- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model
- have the qualities that a buyer can legitimately expect in view of public statements made by the seller, producer or his representative, in particular in advertising or labelling
- Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

The action resulting from the lack of conformity shall be prescribed after two years from the date of delivery of the goods.
▪ Article 1641 - Civil code
The seller is bound by the warranty for hidden defects in the item sold that make it unfit for the use for which it is intended, or that reduce this use so much that the buyer would not have acquired it, or would have given only a lower price, if he had known them.
▪ Article 1648 paragraph 1 Civil code
The action resulting from the fundamental defects must be brought by the purchaser within two years of the discovery of the defect.
▪ Consumer Protection
If you are a consumer, these General Terms and Conditions of Sale do not affect any rights you may have under the law as a consumer and nothing in these General Terms and Conditions of Sale shall exclude or limit our liability under consumer protection legislation, our liability for fraud or death or personal injury caused by our negligence, or any other liability to the extent that we cannot legally exclude or limit it.
Intellectual Property
Unless otherwise specified in written form, the copyright and other intellectual property rights in all JLE, Arnette, Doin and Pradel journals and book collections shall remain theirs. The rights granted are intended solely for the client's use and may not be assigned, transferred or granted without the prior written consent of JLE Publishing. The client will not acquire any intellectual property rights on the journals and books.
No commercial reuse of articles obtained after payment or free of charge is allowed.
Right of withdrawal
Except in the cases referred to further below, consumers in the European Union (and in accordance with Articles L. 121-21 et seq. of the Consumer Code) have the right to cancel their purchase up to fourteen (14) days after the date of delivery of the product or the day on which the service was purchased by sending by e-mail to contact@jle.com a notice of withdrawal to the customer service of the site (or any other written means that we recommend you to send by registered letter with acknowledgement of receipt to JLE - 30 rue Berthollet - Bâtiment A - 94110 Arcueil, France).
A sample withdrawal form is provided at the bottom of the page for your use.
This withdrawal right applies to all products and services offered by the site, with the exception of:
▪ digital content that has not been recorded on a physical medium (e. g. e-books, pay-per-view) once it has been viewed or downloaded;
▪ newspapers, periodicals and magazines that are not provided under subscription contracts.

Returns
You must return the goods within a reasonable time and in any event no later than 14 days after the date of notification of your withdrawal. We will then proceed with the refund within a reasonable time.
